Terms of Service

This document describes how you may use Character Toolkit. It is provided so users and third-party platforms (including Google OAuth) can review our rules before signing in. Sections involving entity structure, payments, refunds, and governing law may be refined as the Service matures; the age, safety, and acceptable-use rules below apply now.

1. Acceptance

By creating an account, accessing, or using Character Toolkit (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility (18+)

  1. You must be at least 18 years old to create an account or use the Service.
  2. You represent that information you provide during account creation (including date of birth for age verification) is accurate.
  3. We may re-verify age and suspend or terminate accounts that cannot confirm eligibility.
  4. This platform is not intended for, marketed to, or accessible by minors. Accounts belonging to minors will be terminated immediately.

3. Accounts

  1. You may sign in via supported OAuth providers (Discord and/or Google). OAuth identity for the website is separate from any future Discord bot application.
  2. You are responsible for activity under your account and for keeping access to your OAuth providers secure.
  3. One person, one account. Creating new accounts to evade suspension or bans is a violation of these Terms.

4. The Service

Character Toolkit provides tools for creating, editing, exporting, and storing fictional character profiles for roleplay and creative writing, including structured character sheets, HTML card generation, AI-assisted suggestions, and (where offered later) image/video generation. Features and availability may change.

5. Acceptable Use

You agree not to use the Service to:

  1. Create, upload, import, or generate content depicting, describing, or sexualizing a minor, or a character coded as a minor, in any romantic or sexual context — including fiction. Zero exceptions.
  2. Create or distribute content that sexualizes real identifiable people without consent, or that violates the rights of any real person.
  3. Upload or import malicious code (including in HTML imports), attempt to bypass sanitization, or exploit vulnerabilities.
  4. Circumvent quotas, subscription gates, rate limits, or access controls.
  5. Scrape or bulk-extract other users' content beyond documented features.
  6. Harass, threaten, or target any real individual.
  7. Misrepresent your identity or impersonate any person or entity.
  8. Upload content you do not have rights to use.
  9. Interfere with or attempt unauthorized access to the Service infrastructure.

6. Zero-tolerance enforcement

Intentional violations of Section 5 — especially anything involving minor safety — may result in immediate, permanent termination without refund. Where required or permitted by law, we may preserve data and disclose it to law enforcement.

7. Your content

  1. You retain ownership of original creative content you write (names, descriptions, stories, and similar).
  2. You grant us a license to host, store, process, display, and transmit that content as needed to operate the Service for you (including exports and AI-assisted features you request).
  3. If you later make content public/shareable, other users may view it as the platform intends; they do not receive a license to claim authorship elsewhere.
  4. Imported third-party material remains your responsibility; you represent you have the right to import it.

8. AI-generated content

AI features (when enabled) are provided as-is. Output may be inaccurate or inappropriate despite safeguards. You are responsible for reviewing generated content before use. Content that violates Section 5 remains prohibited whether human- or AI-authored.

9. Subscriptions and billing

Some features may require paid subscriptions in the future. Pricing, processors, refunds, and quotas will be described on the Service when billing launches. Until then, free-tier / test access rules apply as stated on the site.

10. Third-party services

The Service uses third parties such as Discord and Google (authentication), hosting and database providers, and (when enabled) AI/compute providers. Your use of those integrations is also subject to their terms and privacy policies. See our Privacy Policy for data details.

11. Moderation

We may review, remove, or restrict content and suspend or terminate accounts for Terms violations, especially for public or shared material. We are not obligated to monitor all private content.

12. Platform intellectual property

The Service software, design, templates, taxonomy, and branding remain our property. These Terms grant only a limited license to use the Service as intended.

13. Copyright complaints

If you believe content on the Service infringes your copyright, contact the operator via the contact method listed in the Privacy Policy with the information required for a valid notice. We will respond as required by applicable law.

14. Termination

You may stop using the Service at any time. We may suspend or terminate accounts for Terms violations or as otherwise permitted by law. Upon termination, your right to use the Service ends; data retention is described in the Privacy Policy.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE. TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50 IF YOU HAVE NOT PAID US.

17. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal fees arising from your violation of these Terms or misuse of the Service.

18. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes take effect constitutes acceptance of the updated Terms.
